MOODIO ACCEPTABLE USE POLICY

1. OVERVIEW
This Acceptable Use Policy ("AUP") governs your use of the Moodio platform and all related services (the "Service"). This AUP is part of and incorporated into the Moodio Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
Moodio's AI generation features are powered by a combination of Moodio's proprietary technology and Third-Party AI Services. This AUP reflects the combined requirements of Moodio and all upstream AI service providers. Where an upstream provider imposes a more restrictive requirement than Moodio's own policies, the more restrictive requirement applies.
Violations of this AUP may result in content removal, account suspension, account termination, forfeiture of credits, and, where appropriate, reporting to law enforcement.
2. PROHIBITED CONTENT
You may not use the Service to create, upload, store, distribute, or facilitate the creation of content that:
2.1 Illegal Content
- Constitutes, promotes, or facilitates illegal activity under applicable law
- Constitutes child sexual abuse material (CSAM) or any content that sexually exploits, endangers, or depicts minors in a sexual context
- Facilitates human trafficking, forced labor, or exploitation of any person
- Constitutes or facilitates fraud, identity theft, phishing, or financial scams
2.2 Violent and Harmful Content
- Threatens, promotes, or glorifies violence against individuals or groups
- Contains graphic depictions of extreme violence, gore, or torture intended to shock or disturb
- Promotes or provides instructions for terrorism, violent extremism, or mass casualty events
- Promotes or facilitates self-harm, suicide, or eating disorders
- Depicts or promotes animal cruelty or abuse
2.3 Harassment and Hate
- Harasses, bullies, intimidates, or threatens specific individuals
- Promotes hatred, discrimination, or violence based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or other protected characteristics
- Contains slurs, dehumanizing language, or calls for exclusion or segregation of protected groups
- Engages in doxxing (publishing private information to harass or endanger)
2.4 Deceptive and Misleading Content
- Constitutes misinformation, disinformation, or deepfakes intended to deceive
- Impersonates any person, organization, or entity without authorization
- Presents AI-generated content as authentic human-created content with intent to deceive, particularly in political, journalistic, or legal contexts
- Creates or distributes synthetic media of real individuals making statements they did not make or performing actions they did not perform, without clear disclosure
2.5 Non-Consensual Intimate Content
- Constitutes non-consensual intimate imagery (including AI-generated "deepfake" pornography)
- Creates sexual or intimate content depicting identifiable real individuals without their explicit consent
- Contains any sexual content involving or appearing to involve minors
2.6 Infringing Content
- Infringes the copyright, trademark, trade secret, or other intellectual property rights of any third party
- Violates the right of publicity or privacy of any individual
- Reproduces, distributes, or creates derivative works of copyrighted material without authorization
2.7 Regulated and High-Risk Content
- Provides specific medical, legal, or financial advice presented as professional guidance without appropriate disclaimers
- Generates content intended to influence elections, including misleading information about candidates, voting procedures, or election dates
- Creates content used for automated decision-making in employment, lending, housing, insurance, or criminal justice contexts without appropriate human oversight
- Generates content that could be used for surveillance, tracking, or monitoring individuals without their knowledge and consent
3. PROHIBITED ACTIVITIES
You may not engage in the following activities in connection with the Service:
3.1 Service Abuse
- Access the Service using automated means, bots, scrapers, crawlers, or any method other than the interfaces provided by Moodio, unless expressly authorized under a separate API agreement
- Circumvent, disable, or interfere with any access control, rate-limiting, credit metering, or security features of the Service
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or any systems or networks connected to the Service
- Interfere with or disrupt the integrity, performance, or availability of the Service
- Use multiple accounts to circumvent restrictions, bans, or credit limits
- Share account credentials or allow others to access your account
3.2 Competitive Use
- Use the Service, Search Library content, AI-Generated Outputs, or any data obtained from the Service to create, develop, train, improve, or benchmark any competing product or service, including any artificial intelligence or machine learning model
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or architecture of the Service or any AI model used by the Service
- Systematically download, archive, or create a database of Search Library content or AI-Generated Outputs for purposes unrelated to your authorized use of the Service
3.3 Content Misuse
- Remove, alter, or obscure any copyright notices, watermarks, AI-generated content labels, or other proprietary notices from content accessed through or generated by the Service
- Redistribute, sublicense, or sell Search Library content as if it were your own or as stock content
- Use AI-Generated Outputs in a manner that violates the terms of the underlying Third-Party AI Service that generated the content
- Re-upload AI-Generated Outputs as User Uploads to circumvent generation credit costs or to obscure the AI-generated nature of the content
4. HUMAN LIKENESS AND RIGHT OF PUBLICITY
4.1 Requirements for Content Depicting Real Individuals
If you use the Service to generate content that identifies or closely resembles a real, identifiable person, you must:
- Have obtained that person's consent (or have a lawful basis) for the specific use
- Clearly and prominently disclose that the content was generated using AI when you publish, distribute, or display it
- Not use such content in a manner that is defamatory, misleading, pornographic, or otherwise harmful to the depicted individual
- Comply with all applicable right-of-publicity and privacy laws in the relevant jurisdictions
4.2 Prohibited Uses of Likeness
You may not use the Service to:
- Generate non-consensual intimate or sexual content depicting real individuals
- Create content falsely attributing statements, actions, or endorsements to real individuals
- Generate content of real individuals for the purpose of harassment, intimidation, or blackmail
- Create content that could reasonably be mistaken for authentic documentation of real events involving identifiable individuals, without clear AI disclosure
5. THIRD-PARTY AI SERVICE COMPLIANCE
Moodio integrates multiple Third-Party AI Services. Your use of the Service is subject to the acceptable use requirements of these providers. Without limiting the foregoing:
All Third-Party AI Services generally prohibit: generating CSAM; creating content to facilitate violence; generating non-consensual intimate imagery; creating weapons or dangerous materials instructions; impersonating individuals for deception; and using outputs to train competing AI models.
The specific AI models available through the Service (and their upstream providers' terms) may change as we add or remove models. Additional restrictions from specific model providers are incorporated by reference and apply when you use those models. Current model availability and any model-specific restrictions are described on the Service.
Moodio may update this Section 5 to reflect changes in Third-Party AI Service requirements. We will provide notice of material changes through the Service.
6. REPORTING VIOLATIONS
If you encounter content or activity that violates this AUP, please report it to us at:

We will review reports promptly and take appropriate action, which may include content removal, account warnings, account suspension, or account termination.
7. ENFORCEMENT
7.1 Enforcement Actions
Moodio may take any of the following enforcement actions for violations of this AUP:
- Warning: A notification that your activity violates this AUP, with a request to cease the violating activity.
- Content Removal: Removal of specific content that violates this AUP.
- Temporary Suspension: Temporary suspension of your account for a specified period.
- Permanent Termination: Permanent termination of your account and forfeiture of any remaining credits or subscription benefits.
- Legal Action: Pursuit of legal remedies, including seeking injunctive relief or reporting violations to law enforcement.
7.2 Escalation
Enforcement actions will generally follow an escalation path (warning → content removal → suspension → termination), but Moodio reserves the right to skip steps or take immediate action for severe violations, including but not limited to: CSAM, credible threats of violence, non-consensual intimate imagery, and illegal activity.
7.3 Appeals
If you believe enforcement action was taken in error, you may appeal by emailing support@moodio.art within 30 days of the action. Include your account information and a description of why you believe the action was incorrect. We will review appeals promptly.
8. CHANGES TO THIS POLICY
We may update this AUP from time to time to reflect changes in law, Third-Party AI Service requirements, or our operational practices. We will provide notice of material changes through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated AUP.
