Datapizza Inc. ("Moodio," "Company," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Moodio platform, website, and related services (collectively, the "Service").
This Privacy Policy applies to all users of the Service worldwide. If you are located in the European Economic Area ("EEA"), United Kingdom ("UK"), or other jurisdictions with specific data protection laws, please also review the jurisdiction-specific provisions in Section 11.
By accessing or using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.
Account Information. When you create an account, we collect your name, email address, username, password (securely stored), and profile information you choose to provide.
Payment Information. When you purchase credits or subscriptions, we collect billing information including payment card details, billing address, and transaction history. Payment card details are processed and stored by our third-party payment processors (Stripe for global users; Alipay for users in mainland China) and are not stored on Moodio servers.
User Content. We collect all content you upload to or create through the Service, including:
Communications. We collect information you provide when you contact our support team, respond to surveys, participate in promotions, or otherwise communicate with us.
Usage Data. We automatically collect information about your interactions with the Service, including pages and features accessed, search queries, generation prompts (in anonymized form), content viewed, clicks, time spent, and feature usage patterns.
Device and Connection Data. We collect device type, operating system, browser type and version, screen resolution, unique device identifiers, IP address, and general geographic location (city/region level, derived from IP address).
Cookies and Tracking Technologies. We use cookies, web beacons, pixels, and similar technologies to collect information about your browsing activity. See our Cookie Policy for details.
Log Data. Our servers automatically record information including your IP address, access times, pages viewed, referring URLs, and system activity.
Authentication Providers. If you sign in using a third-party service (e.g., Google, Apple, or other providers we may support), we may receive your name, email address, and profile picture from that service, as authorized by your privacy settings with that provider.
Third-Party AI Service Providers. When you use AI generation features, Third-Party AI Services may provide us with metadata about the generation process (e.g., content safety classifications, processing logs).
Analytics Providers. We may receive aggregated analytics data from third-party analytics services.
We use the information we collect for the following purposes:
Providing and Operating the Service. Processing your requests, generating AI outputs, displaying search results, managing your account, processing payments, and providing customer support.
AI Generation and Processing. Using your inputs (prompts, reference images, reference videos) to generate AI-powered outputs through our proprietary technology and Third-Party AI Services. This involves transmitting your inputs to AI model servers for processing.
Service Improvement and AI Model Training. Using Your Content (in anonymized or aggregated form where practicable) to improve, train, test, and develop our AI models, algorithms, and Service features. You may opt out of having your content used for AI model training by contacting us at support@moodio.art, subject to the limitations described in our Terms of Service. Enterprise plan customers may negotiate contractual restrictions on AI training use.
Safety and Content Moderation. Scanning and analyzing content using automated systems to detect violations of our Terms of Service and Acceptable Use Policy, including illegal content, copyright infringement, and harmful material.
Communications. Sending you service-related notices, account updates, security alerts, and (with your consent where required) marketing communications. You may opt out of marketing communications at any time.
Analytics and Personalization. Analyzing usage patterns to understand how the Service is used, personalize your experience, recommend content, and improve features.
Legal Compliance and Protection. Complying with legal obligations, responding to lawful requests from authorities, enforcing our Terms of Service, and protecting the rights, safety, and property of Moodio, our users, and the public.
We do not sell your personal information. We share your information only in the following circumstances:
Third-Party AI Service Providers. When you use AI generation features, your inputs (prompts, reference images) are transmitted to Third-Party AI Service providers for processing. These providers process your data solely to generate outputs at your direction and are contractually prohibited from using your data for their own purposes, except as described in their respective terms of service. Current Third-Party AI Service providers are listed on the Service and may change over time.
Cloud Infrastructure and Hosting. We use cloud service providers to host and operate the Service. These providers process data on our behalf under data processing agreements.
Payment Processors. Payment information is processed by Stripe (for global payments) and Alipay (for payments in mainland China). These processors handle your payment data under their own privacy policies.
Analytics and Measurement. We share anonymized or aggregated data with analytics providers to help us understand Service usage.
Legal Requirements. We may disclose your information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect the rights, safety, or property of Moodio, our users, or the public.
Business Transfers. In connection with a merger, acquisition, reorganization, bankruptcy, or sale of assets, your information may be transferred to the successor entity.
With Your Consent. We may share your information for other purposes with your explicit consent.
Public Content. If you choose to make Your Content public on the Service, it may be viewed by other users and indexed by search engines.
We retain your information for as long as your account is active or as needed to provide the Service. Specific retention periods:
Account Information: Retained for the duration of your account plus a short period after deletion to allow for account recovery.
User Content: Retained until you delete it, plus a reasonable period in backups. Content that has been incorporated into AI models in anonymized or aggregated form is not subject to individual deletion.
Payment Records: Retained for 7 years as required by tax and financial regulations.
Usage and Log Data: Retained for a reasonable period, then anonymized or deleted.
Communications: Retained for a reasonable period after the last communication.
Upon account deletion, we will delete or anonymize your personal information within a reasonable timeframe (typically within 45 days), except where retention is required by law or for the limited purposes described above.
We implement technical and organizational measures to protect your information, including encryption, access controls, and security monitoring. We continually work to improve our security practices.
No method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.
Account Settings. You may update your account information, adjust privacy settings, and manage content visibility through your account dashboard.
Content Deletion. You may delete Your Content through the Service at any time, subject to the retention periods described in Section 5.
Communication Preferences. You may opt out of marketing emails by clicking the "unsubscribe" link in any marketing email or adjusting your notification settings.
Cookie Preferences. You may manage cookie preferences through our cookie consent tool or your browser settings.
If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:
Right to Know. You may request information about the categories and specific pieces of personal information we have collected, the sources of collection, the purposes of collection, and the categories of third parties with whom we share personal information.
Right to Delete. You may request deletion of your personal information, subject to certain exceptions.
Right to Correct. You may request correction of inaccurate personal information.
Right to Opt Out of Sale/Sharing. We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising.
Right to Limit Use of Sensitive Information. You may limit our use of sensitive personal information to purposes necessary to provide the Service.
Non-Discrimination. We will not discriminate against you for exercising your CCPA rights.

Data Transfers. Your data may be transferred to and processed in the United States. We rely on appropriate transfer mechanisms under applicable law (such as Standard Contractual Clauses) for transfers to countries without an adequacy decision.

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information. If you believe a child under 18 has provided us with personal information, please contact us at support@moodio.art.
The Service may contain links to third-party websites and services. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you access.
Input Processing. When you submit content for AI generation, your inputs are processed by AI systems to produce outputs. Inputs may be temporarily stored in processing pipelines and are deleted from active processing systems after processing is complete.
Content Safety Scanning. All content (inputs and outputs) is automatically scanned for safety and policy compliance. This scanning may involve analysis by both Moodio systems and Third-Party AI Service safety systems.
Metadata and Watermarking. AI-Generated Outputs may contain embedded metadata or invisible watermarks identifying them as AI-generated content. This metadata may include a Moodio service identifier and content ID but does not include your personal information.
AI Model Training. As described in Section 3, we may use Your Content (in anonymized or aggregated form where practicable) for AI model training and improvement. Specific inputs are not individually retrievable from trained models. Enterprise customers may negotiate opt-out provisions.
Moodio is headquartered in the United States. Your information may be transferred to, stored, and processed in the United States and other countries where we or our service providers operate. These countries may have different data protection laws than your country of residence.
For transfers from the EEA, UK, or Switzerland, we rely on appropriate transfer mechanisms under applicable law, including Standard Contractual Clauses where applicable, along with additional technical and organizational safeguards.
For users accessing the Service through our China entity, data is stored on servers located in mainland China in accordance with Chinese data localization requirements. Please refer to the China-specific privacy policy for additional information.
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Service and updating the "Last Updated" date. For material changes that significantly affect how we process your personal information, we will provide at least 30 days' advance notice via email or in-product notification.
